Terms of Service

1. Acceptance
By creating an account or using Picsta, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. If we change these terms in a material way, we'll ask you to re-accept them before you continue using your account.
2. Your account
- You must be at least 16 years old (or the minimum digital-consent age in your country, whichever is higher) to create an account.
- You are responsible for keeping your credentials secure and for all activity under your account. If you sign in with Google, keep your Google account secure.
- Tell us at [email protected] immediately if you suspect unauthorised use of your account.
- One person, one account. Don't share login credentials with others — use Picsta's sharing features instead.
3. Your content
You keep full ownership of every photo and piece of content you upload. Picsta does not claim any ownership over your content.
To run the service you give us a limited, non-exclusive, royalty-free licence to host, store, process, transform (resize, generate thumbnails, extract face embeddings, build search indexes) and deliver your content — but only for the purpose of providing the gallery, sharing, search and download features you signed up for. This licence ends when you delete the content or your account.
We do not use your content for advertising, training third-party AI models, or any purpose unrelated to running Picsta for you.
4. Photos of other people
When you upload photos of people other than yourself, you confirm that:
- You have the right to upload those photos under your local law.
- You have any consent or legal basis required to upload identifiable images of those people — particularly children, and particularly for galleries that will be shared.
- You will honour reasonable removal requests from the people in the photos. If someone asks you to take their photo down, take it down.
If somebody contacts us about a photo of themselves in your gallery and we can't reach you, or you refuse a legitimate request, we may remove that photo ourselves.
5. Face recognition ("Find Me")
Find Me is an opt-in feature. By turning it on and uploading a selfie, you give us your explicit consent to extract and store a face embedding from that selfie, and to use it to match your face against photos in galleries you have permission to view.
You can withdraw this consent at any time by deleting your selfie from Settings → My Face. The full details of how we handle face data — what we do and don't do with it, and how deletion works — are in section 4 of our Privacy Policy.
6. Acceptable use
You may not use Picsta to:
- Upload illegal content, including content that infringes someone else's copyright, trademark or other rights.
- Upload sexual content involving minors. We report this to law enforcement immediately and terminate the account.
- Upload non-consensual intimate imagery, "revenge porn", deepfakes designed to deceive or harm someone, or any image-based sexual abuse.
- Upload images of people who have asked not to be uploaded, or use Find Me to track, stalk, harass, dox or surveil another person.
- Use Picsta to host content that promotes terrorism, organised violence, or hate against a protected group.
- Attempt to bypass access controls, share-link PINs, rate limits, or account-isolation boundaries.
- Reverse-engineer, scrape, automate access to, or resell the service or its data.
- Use the service in a way that interferes with other users or with our infrastructure (denial-of-service, abusive load, etc.).
We may remove offending content and suspend or terminate accounts that break these rules.
7. Sharing & viewers
When you share a gallery via a share link or invite, the people you share with can view (and, if you allow it, download) the photos in that gallery. You are responsible for who you share with, and for using PINs and other controls if you want to restrict access.
Viewers must follow these same Terms when interacting with a gallery — they may not download for redistribution, scrape, or attempt to bypass any access control.
8. Copyright & takedown
If you believe content on Picsta infringes your copyright or other rights, email us at [email protected] with:
- A description of the work you say has been infringed.
- The link(s) to the content on Picsta you want removed.
- Your contact details.
- A statement that you have a good-faith belief the use is not authorised, and that the information in your notice is accurate.
We review every notice we receive and remove content where the claim is valid. Repeat infringers will have their accounts terminated.
9. Billing, plans & payments
Picsta is free to start. Some limits and features require a paid plan. Our current plans and prices are listed on the Pricing page.
- One-time payments, no auto-renewal. We do not store your card details and we never charge you automatically. Each purchase is a single, deliberate payment.
- Personal plans are valid for 12 months from the date of purchase. When the term ends the plan lapses back to Free until you choose to renew. Nothing is auto-charged.
- Group event plans are a single one-time purchase. Any active member of a group can upgrade and pay, and the higher limits then apply to every contributor in that group regardless of who paid.
- Prices & taxes. Prices are shown in your local currency, determined automatically by your location — Indian Rupees in India, British Pounds in the United Kingdom, and US Dollars elsewhere. Prices in Indian Rupees are inclusive of applicable taxes; for other currencies, any applicable taxes are calculated and added at checkout. We may change prices from time to time; the price shown at the moment you pay is the price that applies to that purchase.
- Payment processing. Payments are processed securely by our payment gateways — Razorpay for payments in Indian Rupees and Stripe for payments in British Pounds, US Dollars, and other currencies. Your use of the payment flow is also subject to the applicable gateway's terms.
- If a plan lapses or you downgrade, content that exceeds the lower plan's limits is retained but may be locked (not deletable by us automatically) until you upgrade again or reduce your usage. We do not delete your photos just because a plan ended.
All purchases are final. Please read our Cancellation & Refund Policy before you buy.
10. Termination & deletion
You can delete your account at any time from Settings → Privacy & Security. If you created an account by mistake, you can remove it the same way — you don't need to contact us.
When you delete your account, your profile, events, albums, photos, selfie and face embedding are permanently removed and cannot be recovered.
We may suspend or terminate your account if you breach these Terms or applicable law, or if we are required to do so by a regulator or court.
11. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We work hard to keep your data safe and the service available, but we cannot guarantee uninterrupted operation, that the service will be error-free, or that any specific photo, face match or search result will be available at any given time.
12. Limitation of liability
To the maximum extent permitted by law, Picsta and its team are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the service — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, or USD 100, whichever is greater.
Some jurisdictions don't allow these limits — in that case the limits above apply to the maximum extent permitted by your local law.
13. Indemnification
You agree to defend, indemnify and hold Picsta and its team harmless from any claim, demand, loss or expense (including reasonable legal fees) arising out of:
- Content you upload to the service.
- Your breach of these Terms.
- Your breach of someone else's rights — including their privacy, image rights, or copyright.
14. Changes to these terms
We may update these Terms as the service evolves. The "Last updated" date at the top will change. For material changes we'll notify you in-app or by email and ask you to re-accept before you continue using the service.
15. Miscellaneous
- Severability. If any part of these Terms is held unenforceable, the rest stays in force.
- No waiver. If we don't enforce a provision on one occasion, that doesn't waive our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or to a successor in connection with a merger, acquisition or sale of assets.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Picsta about the service, and supersede any earlier agreement on the same subject.
- Force majeure. Neither party is liable for failures caused by events outside their reasonable control (natural disasters, infrastructure outages, government action, etc.).
